The Moderate Income Housing Unit (MIHU) Program is an inclusionary zoning program that requires developers of new housing in certain zoning districts to sell or rent a portion of the dwelling units to households of moderate income.

For Developers:
Title 13 Subtitle 402 establishes the MIHU laws for builders or developers
- Any residential zoning district, or portion of a zoning district, where a moderate income housing unit obligation is required by the Zoning Regulations; and
- Any development for which the provision of moderate income housing is proffered by the petitioner and made a condition of approval in a preliminary development plan approved by the Zoning Board.

For applicants:
The MIHU Program is an inclusionary zoning program that requires developers of new housing in specific zoning districts to sell or rent a portion (generally 10-15%) of the dwelling units to households of moderate income. MIHUs are sold or rented at affordable prices and rents set by the Department of Housing and Community Development.
